By accessing or using the BdaySurprise platform, including our website and digital birthday experience tools (collectively, the "Service"), you agree to be bound by these Terms of Service. If you do not agree to all of these terms, do not use our Service.

These terms constitute a legally binding agreement between you and BdaySurprise regarding your use of the platform. We reserve the right to refuse service to anyone for any reason at any time.

BdaySurprise provides an interactive platform for creating, customizing, and sending unique birthday experiences. Features include themed interactive pages with candle-blowing, balloon-popping, and gift-selection mechanics delivered via a shareable link.

To access certain features, you must register for an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must provide accurate and complete information during registration and keep this information up-to-date.

"You must be at least 13 years old to create an account. Users under 18 must have parental or legal guardian consent to use the paid features of the Service."

Our platform utilizes "PartyCoins," a virtual credit system for creating and publishing birthday surprises. PartyCoins are non-refundable once spent on a published surprise, but unused balances may be refunded within 14 days of purchase.

All payments are processed through secure third-party providers. By initiating a transaction, you authorize us to charge the selected payment method for the total amount of your purchase, including applicable taxes.

You agree not to use the Service to:

• block Upload or transmit content that is unlawful, harmful, threatening, or harassing.
• block Infringe upon the intellectual property rights of others.
• block Distribute viruses or other malicious code designed to disrupt the Service.
• block Use automated systems (bots, scrapers) to access the Service without authorization.

Starter surprise links are accessible for 30 days. Pro links remain active for 90 days. BdaySurprise reserves the right to archive or delete content from inactive accounts after 12 months of non-use to maintain system performance.

We may modify these terms at any time. We will notify you of any material changes by posting the new terms on this page and updating the "Last updated" date. Your continued use of the Service after such changes constitutes your acceptance of the new terms.
